HOT CAR

These Terms and Conditions govern sales made on the Hot Car online data systems. You agree to be bound by these Terms and Conditions by clicking on the "Agree" checkbox on the register page. We reserve the right to amend these Terms and Conditions at any time by posting amended terms and conditions on our website with a revised effective date.

The terms Hot.Car or Hot Car or "us" refers to American Channels, LLC. a Virginia Corporation. Our contact details are listed on the website page "INFO". The terms 'you' and 'your' refer to the owner of the auto and user of our online data systems.

• Auto Owner Revenues:You acknowledge that any show won through our online systems may not have any actual revenue or trophy given upon the basis of auto owners' link "clicks" as best as we can assess real non-cheated traffic.  We will not be held accountable for cheating traffic and make effort every day to detect and prevent fraudulent or artificial traffic. Any revenue sharing shall be only from that revenue collected by us for sales at officially sponsored shows by Hot.Car. If there is any revenue for winning Hot Car's officially sponsored events, owners shall be provided by the 15th of each month following each "show" regular monthly occurrences. Any revenue collected that may have been provided to all officially sponsored show winners and places shall not exceed 50% of the overall revenue collected by that officially sponsored show for participating auto owners and not less than 50% of the show revenue shall be allocated to Hot Car. These exact revenue sharing from officially sponsored shows shall be a result of owner participation, machine algorithms and factors of placing, geography, and other factors, used to determine show winners, and other competition places, as coded and selected for revenue sharing for that particularly officially sponsored show by Hot Car.  Shared revenue shall be deposited into your online account or a check shall be mailed within 30-60 days after initial collection.
• Auto Revenue Exclusion: You may avoid revenue sharing with us at any time by removing your auto from our online data systems. This removal shall include both our Online Data Systems and monthly membership. This action shall be executed immediately and results in an immediate end to billing cycles of the month and immediate auto data removal. Autos removed from our data systems shall not be subject to any revenue sharing for the entire billing month of the removal with us. We cannot split any month's possible revenue from an officially sponsored show event by Hot Car.
• Monthly Rates: Rates for auto data are subject to change in any next monthly cycle. Prices changes do not alter any revenue shared terms. Price changes are effective immediately upon that monthly cycle but may not be propagated to any particularly hosted auto until that auto is due for another month of data terms.
• Availability: We offer all software and data services with best daily effort but downtime does occur.  Service and data restoration times may be longer and lead to down times (as we restore). We will email you with important updates in the event of a longer outage or lost or stolen data.
• Payment Options:We can offer Paypal or Zelle Payment options for auto show winners of officially sponsored shows.

THE FOREGOING WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, EITHER EXPRESS, IMPLIED, OR STATUTORY, REGARDING THE PRODUCTS, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT OF THIRD PARTY RIGHTS.

IN NO EVENT WILL WE BE RESPONSIBLE OR LIABLE TO YOU OR ANY THIRD PARTY MEDIA POSTED BY ANY AUTO OWNER, OR INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL OR CONTINGENT DAMAGES ARISING FROM OR RELATING TO SHOWN MEDIA OR STOLEN OR BREACHED DATA, EVEN IF WE HAVE BEEN THE HOLDER OF THE INFORMATION OR MEDIA. SECTION 230 OF THE COMMUNICATIONS DECENCY ACT OF 1996 PROTECTS INTERNET SERVICE PROVIDERS FROM MOST USER-GENERATED CONTENT LIABILITY. THIS FEDERAL LAW PREVENTS LAWSUITS AGAINST ONLINE PLATFORMS FOR USER CONTENT.  OUR TOTAL CUMULATIVE LIABILITY IN CONNECTION WITH THIS STORAGE, INCLUDING FOR ANY LIABILITY ON ACCOUNT OF A CLAIMED DEFECT IN ANY TRANSIT OR STORAGE OF INFORMATION, WHETHER IN CONTRACT OR TORT OR OTHERWISE, SHALL IN NO EVENT EXCEED THE PURCHASE PRICE OF THE MONTHLY AUTO DATA SERVICE OR A SINGLE MONTH OF DATA FEES FOR ANY INDIVIDUAL CUSTOMER. ALL SALES ARE FINAL, NO RETURNS WILL BE ACCEPTED.
